Delaware’s annual statewide open burn ban begins May 1, 2026, and lasts through September 30, 2026, targeting ozone season to improve air quality. Most outdoor burning is prohibited, with violations punishable by fines. Small, recreational fires—like cooking or campfires—are still allowed, provided they use firewood, charcoal, or propane.
Burn Ban Details & Rules (May 1 – Sept 30, 2026):
-
Prohibited: Burning leaves (including pine needles), grass, trash, construction debris, and general yard waste.
-
Permitted: Small, contained recreational fires (campfires, patio pits, chimeneas) and cooking fires.
-
Safety Limits: Permitted fires must be kept small (e.g., 27 cubic feet for campfires).
-
Alternatives: Residents are urged to use municipal yard waste drop-off sites or compost, as burning brush is prohibited during this time.
-
Air Quality Action Days: All open burning, including recreational, is prohibited on days designated as Code Orange or Code Red.
The ban is enforced by the DNREC Environmental Crimes Unit to reduce air pollution during warmer weather.
